California and Washington Join Jurisdictions Requiring Pre-Employment Pay Transparency
Effective January 1, California and Washington joined a growing list of jurisdictions requiring employers to be transparent about their pay. The new laws require employers to include a salary range in job postings, and are similar to a 2021 Colorado law and an ordinance that went into effect in New York City last year.

New California Law Requires Companies to Include Pay Information in Job Postings, Joining Growing List of Jurisdictions Seeking to Provide Workers With Greater Pay Transparency
Beginning on January 1, 2023, California’s SB 1162 will require California companies with over 15 employees to include pay scale information in job postings. This means that nearly 200,000 employers will soon have to provide the salary or hourly wage range that they “reasonably expect” to pay for the position.

New York City Salary Range Transparency Act Revised
Beginning November 1, 2022, a new salary transparency law which amends the New York City Human Rights Law (NYCHRL) will require most employers in New York City to list a salary range or hourly rate in all job advertisements. Although the law was originally scheduled to go into effect on May 15, 2022, as MSE previously reported, it will now become effective November 1.

New York City Commission on Human Rights Issues Guidance on New Salary Transparency Law
Beginning May 15, 2022, most employers in New York City will be required to list a salary range in all job advertisements. In preparing for the new salary transparency law to go into effect, the New York City Commission on Human Rights recently issued guidance to employers and employees about their rights and obligations under the law.

In the latest move to encourage salary transparency and equity, New York City will make it mandatory for companies to disclose salary ranges on all New York City-based job postings.
