Papa John’s delivery drivers have asked a federal judge to approve a $20 million settlement for a wage violation suit. The case is Durling, et al, v. Papa John’s International, and if approved, the settlement could become the largest settlement for pizza delivery drivers in recent similar cases.
The Papa John’s delivery drivers alleged that the company’s reimbursement policies pushed the drivers’ wages below the state and federal minimum wage rates in violation of various state and federal wage laws, including the Fair Labor Standards Act (FLSA). The drivers allege that Papa John’s failed to adequately reimburse them for vehicle-related expenses and their failure to do so under cut their wage rates to push them under the minimum wage.
The case, which has been in litigation for at least 7 years, covers approximately 50,000 delivery drivers in Kentucky, Colorado, Florida, Maryland, Minnesota, and Illinois who consented to join the case. The District Court of the Southern District of New York must approve the terms of the settlement agreement and evaluate the settlement for fairness.
