In Conklin, et al. v. United States Postal Service, Case No. 1:23-CV-07122, a group of 67 Postal Inspectors sued the United States Postal Service for unpaid overtime earned while attending Basic Inspector Training (“BIT”), a 16-week residential training program required by the agency before Postal Inspectors could commence their regular job duties.
At BIT, Postal Inspectors regularly worked beyond 8 hours in a day and/or 40 hours in a workweek, attending classes, participating in mandatory runs and PT sessions, traveling off site for special training events, and performing other compensable work without overtime pay.
Although normally exempt from the FLSA, Postal Inspectors at BIT—because they had not yet commenced their regular, exempt job duties—were entitled to one and one-half times their regular rate of pay for all overtime worked.
Fortunately, Plaintiffs in Conklin have reached a settlement in which the Postal Service has agreed to pay the 67 plaintiffs a total of $700,000.
