MSE Files Complaint on Behalf of 1000+ D.C. Police Union Members

On October 5, 2020, McGillivary Steele Elkin LLP filed a Complaint in the U.S. District Court for the District of Columbia on behalf of over one thousand members of the D.C. Police Union who are employed as police officers, detectives and sergeants by the District of Columbia Metropolitan Police Department and who have not been paid the overtime compensation due under the Fair Labor Standards Act (FLSA) during the COVID-19 Public Health Emergency.

Specifically, the lawsuit seeks to recover unpaid overtime resulting from the District’s failure to include the $14 per diem hazard payments provided to District employees required to report for duty in-person during the Public Health Emergency in the employees’ regular rates of pay upon which their overtime rate is based. This failure results in the employees receiving overtime compensation at an unlawfully low rate when they work in excess of the FLSA’s overtime threshold and represents a clear violation of the law. The lawsuit seeks backpay equal to the unpaid overtime owed to plaintiffs for the miscalculation of their overtime rate as well as an equal amount as liquidated damages.
