Two former employees of the St-Ned Pizza chain, which specializes in gourmet cannabis pizza in New York City, sued for wage and hour violations on December 22, 2022.
Plaintiffs claim that they were not paid minimum wage by the pizza chain, and that they were not paid time and a half for the hours they worked in excess of 40 per week, in violation of the Fair Labor Standards Act and New York’s Labor Law. Plaintiffs also claim that St-Ned Pizza failed to provide wage notices required by New York law, and violated New York’s Spread of Hours law, which requires employers to pay an extra hour of compensation at the minimum wage (currently, $13.20 per hour) if the employee’s total workday is more than 10 hours long. Beginning December 31, 2022, the minimum wage in New York will increase to $14.20, except in New York City, Long Island, and Westchester County, where the minimum wage will remain $15.00.
St-Ned Pizza and the other named defendants have not responded to plaintiffs’ complaint.
In New York, cannabis use has been decriminalized for medical purposes under state law since 2016, and for recreational use since March 2021.
