McGillivary Steele Elkin LLP managing partner Greg McGillivary and partners David Ricksecker and Megan Mechak offered their insight and expertise as featured panelists at the American Bar Association’s 13th Annual Labor and Employment Law Conference held in New Orleans.

The conference was for labor and employment lawyers nation-wide who are passionate about the advancement of their education and want to share and connect with other leading attorneys in the field.

Greg, Megan and David share what they discussed on their panels below.

Greg: “Navigating State Wage and Hour Laws”, moderator and panelist along with attorneys Robyn Klinger and Andy Head.

Our panel was able to cover a breadth of topics including: How Amazon has been losing cases for unpaid work time going through security screenings in states without portal to portal laws; predictive scheduling laws (i.e., employees work schedules must be scheduled well in advance) and penalties for failing to do so; the Dynamex decision on independent contractors and its impact in other states such as Massachusetts and Illinois; state requirements that employees not pay for uniforms, tools nor incur other expenses such as wear and tear on their cars; and pay transparency laws. Even if the federal FLSA does not provide relief, your state law might!

Megan: “Crafting Winning Opening Statements and Closing Arguments for a Judge or Arbitrator”, panelist with the Hon. LaShann DeArcy Hall (U.S. District Court for the Eastern District of New York) and Denise Drake, and moderated by the Hon. (Ret.) Irma Gonzalez.

The panelists discussed strategies for effectively telling your story before a judge or arbitrator. Singing the theme song from Rent may not work in a bench trial or arbitration, but there are plenty of ways to ensure you engage the judge or arbitrator.

David: “Valuing a Wage and Hour Case and Calculating Damages”, panelist along with Federal Judge, Hon. Mary Scriven (M.D. Florida), mediator Hunter Hughes and attorney Lawrence Morales, moderated by attorney Theodora Lee.

Our panel covered calculating damages, addressing damages in mediation or settlement talks, alternate methods to capture work time, presenting damages at trial and recovering attorneys’ fees and costs.
