Cannabis Product Coordinator Settles Case for Unpaid Overtime
On March 6, 2023, Peter Brutus settled a claim against his employer for alleged violations under the Fair Labor Standards Act (FLSA). Brutus is a product coordinator for Trulieve, Inc., a multistate cannabis operator. Brutus alleged that while he regularly worked more than 40 hours per week, that he was not paid time-and-a-half for the overtime hours he worked.

MTA Sued by Employee for ‘Unlawful’ Cannabis Test and Termination
An employee of the Metropolitan Transit Authority (MTA) and the Long Island Rail Road sued his employer in federal court stating that he was wrongfully fired after an unlawful drug test found trace evidence of cannabis use. The employee alleges that the testing and subsequent firing was unconstitutional and violated the Fourth and Fourteenth amendment protections of due process rights and against illegal searches and seizures.

Supreme Court Upholds Salary Requirements for FLSA Overtime Exemption
On February 22, 2023, the Supreme Court of the United States held in Helix Energy Solutions Group Inc. v. Hewitt, that to be exempt from the requirement of being paid overtime after working over 40 hours a week, an employer must pay an employee their full salary in any week in which they perform work.
