Starting on January 1, 2024, Maryland’s minimum wage will increase to $15.00 per hour for all employees. This increased the minimum wage by $1. This increase to the minimum wage marks the end of a gradual increase to Maryland’s minimum wage over the past few years. The $15.00 minimum wage will apply to employers regardless of size.

The minimum wage increase not only affects the rate of pay for all workers at minimum wage but also has an impact on the applicability of non-compete agreements. Maryland has long banned non-compete agreements for workers making less than $15 per hour. Starting in January 2024, the non-compete ban adjusts to take into account the minimum wage increase. The wage threshold for a ban on a non-compete agreement applies to those earning 150% of the state minimum wage or less and will adjust to $22.50 per hour (or $46,800 annually) on January 1.
